Contractor’s $14M claim is forfeited by own breach

A technology company that breached its state contract by intentionally failing to timely pay its subcontractors and falsely certifying it had paid its subcontractors on time could not recover damages from the project owner for allegedly withholding payment for completed work, a Superior Court judge in the Business Litigation Session has ruled. The technology company represented by Holland & Knight attorney Robert Kaler had sued a state agency after they withheld millions of dollars in a dispute over alleged delays and disruptions.

"Although nobody's perfect, and sometimes people breach, the problem arises where people intentionally breach contracts just to benefit themselves," Mr. Kaler said. "As they say, 'the law does not countenance that.'"
