Paul C. Workman is a partner in the Los Angeles office of Holland & Knight. He has nearly 30 years of experience litigating complex business disputes in the state and federal courts in California. Mr. Workman represents both U.S. and foreign clients in jury and bench trials in the state and federal trial courts in California and in related appellate proceedings in the California Court of Appeal, the Supreme Court of California, and the U. S. Ninth Circuit Court of Appeals. He also has extensive experience representing clients in international and domestic arbitrations administered under rules promulgated by the American Arbitration Association, the International Chamber of Commerce, and the United Nations Commission on International Trade Law. Mr. Workman's litigation experience also includes years of case mediations and other alternative dispute resolution mechanisms.

Reflecting his breadth of experience, Mr. Workman's cases have involved claims of fraud, breach of contract, breach of fiduciary duty, defamation, antitrust violations, unfair competition, trademark infringement, computer fraud, misappropriation of trade secrets, business torts, employment termination, breaches of agreements and duties arising from joint ventures, limited liability companies and partnerships, insurance coverage, real estate and environmental clean-up cost recovery.

Mr. Workman has significant experience in representing foreign companies in California-based litigation, and has been instrumental in successfully defending major foreign companies in California lawsuits involving damage claims for millions of dollars. He has vast experience dealing with issues relating to jurisdiction and discovery taken both in California and abroad on behalf of foreign clients.

Representative Matters

  • Co-lead counsel on behalf of plaintiffs seeking to enforce oral ownership agreements with respect to international courier and money-remittance business. The case favorably settled on eve of Los Angeles Superior Court trial for substantial eight-figure amount.
  • Lead counsel in defense of ten Korean Banks sued in state and federal courts in California for negligence and fraud in connection with over $66 million in unpaid bills of exchange used to finance the export of computers from Korea to the U.S. After four years of litigation, the banks were dismissed without having to pay any money.
  • Lead counsel for large publicly-traded Japanese maker of copiers sued in federal court in Los Angeles for wrongfully terminating a U.S.-based distributer. The case was successfully settled for a nuisance amount.
  • Lead counsel for national payroll company and subsidiary sued by licensees of payroll software in twenty-eight separate actions in federal and state courts in California alleging breach of software licensing agreement, fraud and business torts. Following five-week jury trial. in lead action, clients prevailed on all counts except breach of contract. Assessed damages were far less than demand, and, combined with summary adjudication of tort claims in other state court cases, and summary judgment in federal cases, resulted in favorable settlement of remaining cases.
  • Lead counsel for plaintiff in a dispute over the termination and buy-out of the membership interest of the founding member of a limited liability company providing offshore IT outsourcing services. Plaintiff recovered $7.5 million following six-week hearing before three-member AAA panel.
  • Lead counsel for aircraft component supplier defending against cost increase from sub-supplier. Declaratory relief was granted in favor of client following two-week AAA arbitration.
  • Lead counsel for the defense of a large Japanese steel company sued by a partner for breaches of contract and fiduciary duty arising from failed scrap-metal joint venture. Case settled for a fraction of the claimed damage amount following grant of summary adjudication of in favor of client on plaintiffs' main claim.
  • Lead appellate counsel for publicly-traded Japanese industrial company seeking coverage under liability policy for costs of replacing defective aircraft components. Although coverage was denied by trial court and Court of Appeal, a substantial eight-figure settlement was achieved following a grant of review by the California Supreme Court.
  • Lead counsel for aircraft component supplier seeking to recover costs following "termination for convenience" of supply contract. Case settled favorably one week into AAA arbitration hearing.
  • Lead counsel for Japanese manufacturer of refrigeration systems in recovering in excess of $400,000 in losses stemming from employee embezzlement.
  • Lead counsel for plaintiff electronics manufacturer in suit in federal court to recover against supplier. Following grant summary judgment in its favor, client recovered approximately $500,000 in damages and all of its attorney fees.
  • Lead appellate counsel on behalf of Indian tribe in effort to overturn trial court grant of summary judgment that contract with municipality to provide services to gaming facility did not comply with California Environmental Quality Act.
  • Lead appellate counsel for plaintiff technology company in successful appeal to Ninth Circuit of federal district court grant of summary judgment in favor of defendant, resulting in partial reversal and reinstatement of key trademark infringement claims and reversal and remand of damages and punitive damages award.
  • Lead counsel in federal court bench trial in San Francisco defending a New York securities firm in an environmental cost-recovery action under CERCLA arising from an alleged predecessor’s quicksilver mining activities in Santa Clara County.
  • Lead appellate counsel in representing health care district before Ninth Circuit Court of Appeal in successful effort to uphold trial court grant of specific performance compelling sale of $50 million medical office building. Trial court judgment was affirmed in full on appeal, and client recovered over $300,000 in attorneys attorneys' fees.
