The Case For Lawyer-Directed Litigation Funding In NY: Part 1

Litigation Partner Peter Jarvis and Litigation Associate Trisha Thompson co-authored a two-part article for Law360 that discusses how lawyer-directed, nonrecourse commercial litigation funding (lawyer-directed funding) in New York has violated the New York RPC 5.4(a) rule.

New York RPC 5.4(a) rule dictates that lawyer fees cannot be shared with nonlawyers.

Mr. Jarvis and Ms. Thompson reviewed the language and history of the Rule 5.4(a) and found that neither the language nor the history of this rule compels the conclusion that lawyer-directed funding violates the rule.
