Find It and Fix It: Texas Incentivizes Air Emissions Compliance of Permian Basin Oil and Gas Operations

For a limited time, the Texas Commission on Environmental Quality (“TCEQ”) is offering a new program for oil and gas exploration and production companies in the Permian Basin to incentivize compliance with air quality rules and regulations, with a particular focus on compliance with emissions event rules. Under the “Find It and Fix It” initiative, TCEQ will exercise enforcement discretion for oil and gas owners and operators who timely address air noncompliance issues in their Permian Basin operations. Notably, TCEQ has stated that owners and operators who do not either participate in the Find It and Fix It program or conduct a self-audit pursuant to the Texas Environmental, Health, and Safety Audit Privilege Act will continue to be subject to TCEQ investigation and enforcement activities.
