Guardian Ad Litem v. Decree 806 of 2020 in Labor Proceeding
Labor attorney Camilo García published an article in Asuntos Legales explaining the concept of a guardian ad litem in labor proceedings. The implementation of Legislative Decree 806 of 2020 permitted the use of data messages and technology to facilitate the personal notification process in judicial proceedings. However, Mr. García points out, this has not been useful in a large percentage of labor proceedings, and because of that the application of article 29 in the Labor Procedure Code, which allows the naming of guardians, is fundamental. In this article, he answers various questions on this topic, including when a guardian ad litem must be appointed and how the guardian ad litem operates under the personal notification criteria set out in the Legislative Decree 806 of 2020.
