Legislation Alert: Expansion of Elder Abuse Restraining Order Statute

Private Wealth Services attorney Jaime Herren co-authored a California Lawyers Association (CLA) article about the passing of Assembly Bill 1243, which took effect on Jan. 1. The goal of this bill is to expand California Welfare and Institutions Code section 15657.03 by allowing state courts to issue restraining orders to protect elder and dependent adults from abuse. Ms. Herren explains that the bill authorizes anti-isolation orders and "specific debt" orders. Anti-isolation orders are intended to prevent elders and dependent adults from unwanted isolation, but they cannot be sought if a person resides in a health, residential or long-term care facility. "Specific debt" orders pertain to debt that was incurred as a result of financial abuse.
