National Interest in the Proposal of Administrative Reforms
Energy attorney Claudio Rodríguez published an article in Expansión about the Federal Executive's administrative reform proposal in Mexico. The proposal aims to allow the review, modification, nullification and revocation of administrative acts that do not respond to the general interest or benefit private interests. The reform proposes changes to 23 administrative laws and seeks to use terms such as national interest, public interest and common good to justify decisions for revocation and contract assignment. Mr. Rodríguez argues that these terms should not be used to justify arbitrary decisions and that it is necessary to institutionalize a concept of the common good to have clear and precise rules in constitutional interpretation.
