The text of the U.S.-EU data transfer agreement includes an expanded role for government enforcers and sets up more compliance regulation and enforcement for companies that want to be certified for cross-Atlantic data transfers.
"As with Safe Harbor, companies will still have to file with the U.S. Department of Commerce, however Commerce can now test companies 'compliance' and the documents indicate that Commerce will actually seek to verify the information before finalizing the self-certifications,” said Senior Policy Advisor Norma Krayem.
