ESOP attorney Greg Brown shares what a company needs to do once it has assessed whether an ESOP is right for it. Then he explains that the process of identifying a team of skilled ESOP professionals should be the next step.
“The company needs an experienced lawyer and an experienced financial adviser. You’re going to want to get an independent trustee with its own lawyer and independent financial adviser,” said Mr. Brown. “You have to get people who understand how to get through the regulatory hurdles and do the thing properly, because if you don’t, you’re going to expose yourself to liability downstream.”
