Insurance attorney Mark Delegal gives his insight on how the fee multiplier was used to motivate lawyers to take on especially risky cases on behalf of plaintiffs. He explains that the multiplier is very rarely used in property damage cases, but says that the possibility of the multiplier is enough to change the behavior of the parties.
"There's no dispute that it's not often done," Mr. Delegal said. "It's just that when they happen occasionally, they drive the behavior of the plaintiffs to be more aggressive and the defendants to be more risk averse."
