SBA Axes VA Small Biz Lease After Finding No Veteran Control

Litigation attorneys Gordon Griffin and Amy Fuentes were highlighted in a Law360 article recapping their recent successful CVE protest before the U.S. Small Business Administration's Office of Hearings and Appeals. Holland & Knight represented protestor Blue Cord DevGroup, LLC, which argued that a lease awarded by the U.S. Department of Veterans Affairs (VA) to a veteran-owned small business had to be canceled because the company was not actually controlled by a veteran. The judge agreed with Blue Cord DevGroup, finding that the individual listed as the majority owner did not control the business and that the business relied too heavily on a subcontractor for managerial duties and financing. As a result of the ruling, the lease is deemed void ab initio. Mr. Griffin said the decision was significant, as it marked the first time the office ordered the rescission of a fully executed lease in response to a successful CVE protest.

"This landmark decision has far-reaching implications," he added.
