SEC Regional Director, Former Enforcement Officials Talk Rulemaking, Fifth Circuit Rulings and More

Securities Enforcement Defense attorney Scott Mascianica was cited in an article published by The Texas Lawbook recapping a discussion on updates and key developments at the U.S. Securities and Exchange Commission (SEC). The event, hosted at Holland & Knight's Houston office, featured SEC Regional Director David Peavler alongside Mr. Mascianica, Rebecca Fike, a partner at Vinson & Elkins, and David Rassin, general counsel at SAExploration. Among the topics covered was the increase in rulemaking initiatives at the agency, which has created uncertainty and sparked questions about compliance, particularly in the area of Environmental, Social and Governance (ESG). Mr. Mascianica offered some simple advice for lawyers helping their clients navigate new requirements.

"Right now, it's if you don't do what you say and say what you mean, then you're going to get charged," he explained. "It's kindergarten-rule type enforcement right now, which is the same type of enforcement we've seen for generations from the SEC."
