Social Media Influencer's Texas Lawsuit Against Rival Could Pave the Way for Future Copyright Cases
Fashion and entertainment law attorney Danielle Garno was quoted in The Texas Lawbook discussing a novel lawsuit filed by a social media influencer seeking to protect an aesthetic by accusing another influencer of copyright infringement. Ms. Garno described the legal challenges of asserting intellectual property rights over a "vibe" or aesthetic, which she argues is not protected by current laws. She also suggested that if a precedent were set in favor of such protections, it could dramatically alter the landscape for social media influencers.
"There's no intellectual property right for [a vibe or an aesthetic] and if there was, Kim Kardashian would have it," she said.
