Stephen T. Ball is an attorney in the Orlando office who practices in the areas of employment discrimination and other employment/labor-related matters such as employment discrimination litigation, Fair Labor Standards Act (FLSA) matters, employment and severance agreements, non-competition agreements and other litigation. He regularly represents employers in employment and labor-related lawsuits in federal and state courts and in investigations and charges before the U.S. Equal Employment Opportunity Commission (EEOC), the Florida Commission on Human Relations and related organizations. He also represents employers in such areas as unemployment compensation appeals and plant closings under the Worker Adjustment and Retraining Notification (WARN) Act.

Mr. Ball is a frequent speaker and commentator for television news stations on labor and employment law topics and is also an experienced trial attorney in the areas of labor and employment litigation, commercial litigation, personal injury defense litigation and appellate practice, in both state and federal courts. He has been awarded numerous honors and was recently recognized by Super Lawyers as a 10-year selectee.

  • Fair Labor Standards Act:
    • Successfully represented a large national digital cable and Internet provider and obtained summary judgment on a collective action on behalf of cable installers regarding on-call pay in the U.S. District Court, Middle District of Florida
    • Represented a large Florida commercial roofing company and obtained summary judgment in federal court on a collective action for travel pay to and from jobsites by workers
  • U.S. Department of Labor Investigations: Represented national companies, including the citrus industry, during Department of Labor investigations
  • Trade Secret/Non-Compete: Successfully represented a national communications defense contractor for violation of proprietary information and trade secrets against former employees
  • Discrimination: Successfully represented numerous corporations in a race, gender, age, national origin and disability discrimination action pending in the U.S. District Courts and state courts in Florida
  • Retaliation/Discrimination: Successfully represented numerous healthcare facilities and providers, national media outlets, national banking institutions, national home builders and national defense contractors in retaliation, gender, race and disability discrimination actions pending in the U.S. District Courts and state courts in Florida
  • WARN Act/Employment Separations: Represented international, national and regional employers in connection with large-scale reductions in force, plant closings and transfer of manufacturing operations, including the issuance of WARN notices, preparation of severance packages, avoidance of wrongful termination claims
  • Occupational Safety and Health Administration (OSHA): Successfully represented a national defense contractor in connection with investigations by OSHA
  • Employment Counseling: Represented an international religious organization and national medical technology companies in connection with preparation of employment agreements and restrictive covenants, including non-compete, non-solicitation and non-disclosure agreements applicable to employees working in multiple states
  • Breach of Contract: Successfully defended an international defense contractor in multimillion-dollar lawsuit for breach of contract
  • Other Litigation: Successfully defended a large national contractor of baggage handling systems and installation for major national airports in a three-week, multimillion-dollar lawsuit by an electrical subcontractor for work done at the Orlando International Airport and prevailed on a counterclaim
