Aaron S. Heishman is a D.C. public policy and regulation attorney who focuses on environmental law issues. Mr. Heishman assists clients with a wide range of environmental matters, including federal and state litigation and administrative enforcement issues, evaluating environmental risks in commercial transactions, and advising real estate developers on purchasing decisions and regulatory closure pathways.

  • Defended real estate developer's approved Endangered Species Act (ESA) Habitat Conservation Plan against citizen challenges
  • Defended mining company against citizen suit alleging Clean Water Act (CWA) violations at eight locations
  • Guided manufacturer accused of historical disposal of hazardous waste at Superfund landfill to advantageous early settlement
  • Defended a CWA permittee against administrative challenge seeking to impose novel effluent limits
  • Represented a city government in a challenge of a federally approved highway project that threatened the city's water supply
  • Challenged the U.S. Environmental Protection Agency's (EPA) administration of the Clean Air Act (CAA) Renewable Fuel Standard Program on behalf of biofuel trade association

  • Advised nationwide retailer and car salvage companies on facility acquisitions
  • Guided contaminated properties to regulatory closure in the District of  Columbia, Maryland, Virginia, Texas, Florida and Oregon
  • Counseled residential real estate developers regarding wetlands permitting issues
  • Helped developers in Washington, D.C., metro area navigate voluntary remediation programs, comply with local stormwater and green building regulations, and enter into stormwater covenants
  • Authored rulemaking comments for District of Columbia developer association regarding proposed regulations on underground storage tank cleanups, stormwater retention and local water system availability fees

  • Served as environmental counsel to insurance underwriters for the issuance of 200-plus representations and warranties (R&W) policies
  • Led environmental due diligence efforts in $3 billion acquisition of global manufacturing company
  • Conducted environmental due diligence efforts in the acquisition of an oil and gas company, a regional grocery store chain and numerous manufacturing companies

  • Advised generators and commercial carriers of hazardous waste regarding best practices to limit liability under the Resource Conservation and Recovery Act (RCRA) and the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA)
  • Resolved enforcement actions brought by the U.S. Environmental Protection Agency (EPA)
  • Navigated voluntary disclosure of noncompliance issues to EPA and state environmental agencies
  • Drafted rulemaking comments on behalf of industry coalition opposing a proposed addition to the Endangered Species Act (ESA) list
  • Drafted rulemaking comments for coal company on EPA's proposed definition of "Waters of the United States"
