Nicholas A.F. Sarokhanian is a Dallas trial attorney with a strong track record of litigating important business disputes before judges, juries and arbitrators. Among other complex litigation matters, Mr. Sarokhanian's practice includes representing clients in massive multidistrict litigation (MDLs) and class actions and obtaining coordinated temporary restraining orders (TROs) and preliminary injunctions in trade secret and non-compete litigation across the country.

Mr. Sarokhanian also regularly litigates matters involving breaches of contract, fraud and fraudulent inducement, patents and intellectual property (IP), restrictive covenants, product liability, governmental and regulatory enforcement, and franchise agreements. He has extensive trial and injunction-related courtroom experience, including cases in state courts, federal district and bankruptcy courts, as well as state and federal appellate courts and matters before private arbitrators.

Mr. Sarokhanian enjoys the challenge of solving tough or novel problems. Mr. Sarokhanian represents and advises clients in a variety of sectors, with a particular concentration on the healthcare and life sciences, financial services and insurance, technology and real estate sectors, and the size of his clients range from Fortune 500 to startup companies. Among other clients, Mr. Sarokhanian represents and advises pharmaceutical and medical device manufacturers, hospitals, home health agencies and physicians; financial institutions, fintech companies, real estate investors, developers and loan servicers; software companies, inventors and drone manufacturers; and hospitality franchisors, franchisees and management companies.

Mr. Sarokhanian is also part of Holland & Knight’s COVID-19 Response Team and advises companies on the impact of government shelter-in-place orders and other issues presented by the pandemic.

  • Represented a behavioral management company in an American Health Lawyers Association (AHLA) arbitration over the termination of a multiyear services agreement
  • Represented major pharmaceutical companies in product liability class actions and multidistrict litigations (MDLs)
  • Represented major optical products manufacturer in Telephone Consumer Protection Act (TCPA) class action in Illinois federal court
  • Represented home healthcare agencies in franchise litigation in Florida state court and AAA arbitration in Georgia relating to Medicare certification and other breaches of contract
  • Represented physicians and medical device company in patent litigation in federal court
  • Defended board-certified pediatric anesthesiologist against criminal and civil allegations of running a "pill mill" brought by the U.S. attorney's office
  • Resolved, on favorable terms, non-compete litigation in Texas state court brought against executive of intraoperative neuromonitoring company
  • Investigated a former employee's unauthorized access of computer systems for a hospital and coordinated with law enforcement for prosecution under the federal Computer Fraud and Abuse Act (CFAA)

  • Obtained temporary restraining order (TRO) and preliminary injunction ordering the return of misappropriated trade secrets and confidential information and full enforcement of restrictive covenants for fintech client in Texas state court
  • Resolved threatened claims against fintech client by a competitor company related to alleged misappropriate of trade secrets and proprietary business information
  • Resolved, on favorable terms, a dispute for fintech lender with former loan servicer
  • Resolved, on favorable terms, federal court litigation on behalf of major national bank related to the enforcement of guaranties of its credit facility involving failed auto dealership

  • Won trial in Texas state court on behalf of major national bank in litigation involving allegations of fraudulent transfers following Article 9 sale to third party
  • Won trial of adversary proceeding in S. bankruptcy court for an investment venture client and revoked a discharge wrongfully obtained by debtor’s complex fraud and various alter egos, reviving the client's multimillion-dollar judgment
  • Won trial in Texas state court for a loan servicer in a breach of contract lawsuit involving indemnification obligations
  • Secured full recovery for client who purchased pledged accounts receivable in Mississippi federal court
  • Obtained summary judgment in Texas state court for bank client in suit brought by competitor bank related to loan participation agreements
  • Defended a major international bank and its subsidiaries in contested foreclosure and lender liability lawsuits in Texas
  • Obtained summary judgment in Texas state court for major national bank in defamation and Fair Credit Reporting Act (FCRA) lawsuit and defended judgment on appeal to the Dallas Court of Appeals

  • Obtained preliminary injunction in federal court on behalf of major national real estate brokerage against former executive who left for direct competitor and defended injunction on appeal to the U.S. Court of Appeals for the Fifth Circuit
  • Obtained TRO and preliminary injunction in Texas state court ordering the return of misappropriated trade secrets and confidential information and full enforcement of restrictive covenants for fintech client
  • Obtained TROs in Texas state court against a group of insurance brokers located in Texas, California and Illinois that left client in a mass defection to competitor and resolved dispute on favorable terms
  • Obtained mandatory preliminary injunction in Texas state court for a technology company in bet-the-company lawsuit, defended injunction in the Dallas Court of Appeals and resolved dispute on favorable terms
  • Obtained preliminary injunction in multiforum trade secrets and antitrust litigation on behalf of major building products distributor against a group of former executives and salespeople, and resolved dispute on favorable terms
  • Secured early dismissal under Texas' anti-SLAPP statute of widely reported defamation suit against Dallas-based syndicated talk radio and media company host and owner
  • Represented major hotel chain in AAA arbitration against developer that breached development agreement
  • Represented major water bottling company in litigation against neighboring landowners for trespass and nuisance following prescribed burn of forest
  • Helped secure favorable jury verdict for a national retail electric provider in a federal jury trial and separate state court jury trial
