Overview

Katie Stenberg represents banks, specialty lenders, private equity funds, healthcare companies and indenture trustees in financial transactions, corporate reorganizations, mergers, acquisitions, divestitures, bankruptcy proceedings, and state and federal court litigation.

She provides counsel to clients in a variety of industries - including healthcare, senior living, technology, manufacturing and logistics - regarding a wide range of matters, such as:

Representative Experience

  • Represented a specialty finance firm in structuring and closing a $15 million debtor-in-possession revolving credit facility to three acute care hospitals
  • Advised a middle market-focused, specialty finance firm regarding its role as agent for the senior secured lenders in the Chapter 11 cases of Allcare Medical and its affiliates
  • Provided counsel to a middle market-focused, specialty finance firm related to their involvement as agent to the senior secured lenders in the Chapter 11 cases of Spectrum Healthcare, LLC and certain of its affiliates
  • Represented a specialty finance firm in a $147.5 million syndicated financing package to a private equity backed provider of mobile equipment services to the urology industry focused on lithotripsy, laser and cryoablation systems
  • Represented a specialty finance firm in a credit facility to a healthcare company with more than 40 skilled nursing facilities

  • Represented administrative agent in documenting $145 million revolving credit facility to a hospital system exiting bankruptcy
  • Represented appointed Indenture Trustee for bonds issued to finance the acquisition and renovation of two skilled nursing home facilities in Texas in litigation to enforce the terms of a confirmed bankruptcy plan of reorganization. The litigation resulted in the reopening of the obligor's bankruptcy case, setting aside the bankruptcy court's order dismissing the obligor's bankruptcy case, and obtaining the appointment of a Chapter 11 trustee to control and administer the nursing home facilities.
  • Acted as financial advisory counsel to the trust company of a large financial services firm in their connection to the senior secured lenders in the Wisconsin Chapter 128 receivership Fortis Management Group, LLC and its affiliates
  • Served as lead debtor's counsel to Promise Healthcare in its restructuring and bankruptcy
  • Negotiated the sale of a number of hospitals for Promise Healthcare and confirmed a plan of liquidation with significant recoveries for unsecured creditors
  • Represented an indenture trustee in obtaining a receiver over a skilled nursing facility located in Alabama, the sale of the facility through a court-appointed stalking horse auction, and the pursuit of third-party claims against the facility’s control person and affiliates

  • Served as special healthcare counsel to HCA in the acquisition of Meadows Regional Medical Center and part of Meadows Health
  • Represented over 100 investors in obtaining a receiver over the oil and gas wells and in purchasing the oil and gas wells at a court-approved stalking horse auction
