Shippers' Case Addresses Atty Fee Awards Under FCA

The amount of attorney's fees awarded under the False Claims Act is applied by the lodestar approach at a reasonable rate. If compensation for delay is necessary to provide reasonable attorneys' fees, current versus historic rates are used to reflect its present value. The result of comparing the recovery obtained and the attorneys' fees being sought, is significant to what is awarded in fee disputes.
