Overview

Anna Hayes is a litigation attorney based in Holland & Knight's Washington, D.C., office. She advises and defends clients in private litigation and government investigations and enforcement actions with a focus on antitrust and competition. Ms. Hayes has worked for her clients to achieve victories at trial, has secured dismissal of investigations by the U.S. Department of Justice (DOJ) and other agencies, and has defended her clients against claims in International Chamber of Commerce (ICC) arbitration. Ms. Hayes represents public and privately held companies, trade associations, nonprofit organizations and educational institutions.

Ms. Hayes' notable representative matters include:

  • defending client against multiple class action lawsuits alleging anticompetitive conduct related to residential real estate sales
  • representing a real estate developer in a six-day trial over a General Services Administration (GSA) leasing dispute involving breach of contract, resulting in a full victory and monetary judgment for her client
  • advising clients in responding to Civil Investigative Demands (CIDs) by the DOJ inquiring into potential Sherman Antitrust Act violations
  • advising clients in responding to grand jury subpoenas
  • counseling companies and trade associations in antitrust compliance
  • representing an engineering, procurement and construction (EPC) contractor in a multibillion-dollar ICC arbitration dispute involving fraud and breach of contract issues arising from the construction of a mega infrastructure project in South America

In addition, Ms. Hayes maintains an active pro bono practice. She has represented a charitable organization in connection with protecting its intellectual property, including trademark registration, and volunteers with the Lawyers' Committee for Civil Rights Under Law to ensure eligible voters' access to participate in elections.

Prior to joining Holland & Knight, Ms. Hayes clerked for the Honorable Marcia Morales Howard in the U.S. District Court for the Middle District of Florida. She was involved in both bench and jury trials in criminal and civil cases and worked on a variety of matters involving the application of federal and state law related to business torts, labor and employment issues, securities litigation and insurance matters.

While in law school, Ms. Hayes served as the executive articles editor for the Florida Law Review. She also worked as a teaching assistant for legal writing and appellate advocacy courses and tutored first-year students in criminal law and civil procedure.
