Overview

David I. Holtzman is an attorney in Holland & Knight's San Francisco office and a member of the firm's Litigation and Dispute Resolution Practice Group. Mr. Holtzman focuses his practice on general commercial litigation and has extensive experience representing both companies and individuals in a broad array of civil disputes in state and federal courts nationwide, as well as arbitrations and mediations. His experience includes representing clients in both bench and jury trials and in appeals.

Mr. Holtzman has broad experience litigating in healthcare, privacy and intellectual property disputes. He has represented healthcare clients in trade secret, copyright, pricing and privacy disputes. Mr. Holtzman regularly counsels clients regarding privacy issues, and has experience defending privacy class actions involving claims under the Health Insurance Portability and Accountability Act (HIPAA). Mr. Holtzman also represents diverse clients in commercial litigation, including in the hospitality, technology, transportation and music industries.

During law school, Mr. Holtzman served on the Georgetown Law Journal as an Executive Editor for the Annual Review of Criminal Procedure. Prior to law school, he worked at a criminal defense firm.

Healthcare Transaction: advised California’s largest public healthcare district on an innovative structural reorganization to partner with a newly created nonprofit management services organization

Constitutional Litigation: successfully represented a large California county in a dispute regarding the addition of a citizenship question to the decennial Census throughout trials and appeals to the U.S. Supreme Court

Privacy Class Action: obtained a dismissal in favor of several healthcare organizations in a class action alleging violations of HIPAA based on the installation of cookies in healthcare websites

Healthcare Provider Litigation: obtained favorable rulings for a healthcare provider in an antitrust, trade secrets and pricing dispute case in the Superior Court, California Court of Appeal and the U.S. District Court for the Northern District of California

Healthcare Provider Litigation: obtained a favorable ruling for healthcare providers in a litigation victory of $300 million against a private insurer in San Francisco

Copyright Litigation: prevailed in a federal jury trial representing the nation's largest publisher of continuing education materials for healthcare professionals in a copyright and trade secrets dispute

Commercial Litigation: successfully represented a private aviation services company in defending a bid protest dispute, at both trial and appeal, ultimately setting new precedent in California regarding the standing of disappointed bidders to bring suit
