Join us for a discussion regarding the upcoming "lame duck" session that follows the November 6 elections. These post-election sessions were once relatively rare. But in recent years, the lame duck sessions have become short windows of time where major decision-making occurs. This year, Congress will return to face an unprecedented number of challenges.

Holland & Knight's experienced lobbyists and attorneys will explain the issues and how the election results could affect a resolution. We'll also discuss what is likely to be resolved now and what will be postponed until the spring, and how you can prepare for the likely outcome.

Issues Impacting the Fiscal Cliff

In a period of a few short weeks, and in-between holiday distractions, President Obama and Congress will need to come to terms with the following issues:

  • expiration of the 2001-2003 (Bush) tax cuts, the Alternative Minimum Tax (AMT) patch, the current estate tax rules and other tax laws 
  • expiration of the Medicare physician payment formula (sustainable growth rate) doc fix and other Medicare provisions 
  • triggering of the automatic "sequesters" (cuts) that would reduce defense spending by 10 percent and domestic spending by 8 percent 
  • the failure to enact any of the regular FY13 appropriations bills 
  • the likelihood of reaching the debt ceiling borrowing limit in early spring
