Overview
Gregory H. Koger is a partner in the Washington, D.C. office of Holland & Knight. Mr. Koger focuses his practice on construction law, government contracts and commercial litigation. He represents owners, contractors, subcontractors and engineers in matters involving complex claims and defenses, general project administration and regulatory and compliance matters.
Mr. Koger has extensive experience representing national and international clients in various settings ranging from direct negotiations to complex multiparty litigation in state and federal court, arbitration, mediation, administrative proceedings and other forums. His experience encompasses all aspects of risk mitigation and dispute resolution involving delay issues, inefficiencies, differing site conditions, defective work and terminations. He has represented clients in disputes involving power and energy projects, infrastructure projects, large commercial office buildings and multifamily residential projects.
In the area of public contracts, Mr. Koger routinely advises clients on a variety of issues concerning federal, state and local government contracts. His work includes prosecuting and defending complex claims, litigating bid protests and representing clients in matters before the General Accountability Office (GAO), the United States Court of Federal Claims and various boards of contract appeals. Further, Mr. Koger counsels clients on compliance issues, audit requirements and other public regulatory matters.
Mr. Koger's transactional and project administration experience spans a broad range of client-oriented legal services. He regularly negotiates and prepares various construction agreements and other industry-related documents.
Additionally, Mr. Koger serves as an associate editor of Holland & Knight's Construction Industry Practice Group's newsletter/alerts, which highlight noteworthy industry-related events and provide valuable insight to industry professionals.
Prior to entering private practice, Mr. Koger served as a judicial law clerk for the Honorable Durke G. Thompson of the Sixth Judicial Circuit of Maryland. Before law school, Mr. Koger was a sworn law enforcement officer with the United States Capitol Police in Washington, D.C., and received two letters of commendation for actions while on duty.
Representative Experience
- Represented the design engineer responsible for designing the Purple Line Project, a multibillion-dollar light-rail transit project located in Maryland, on matters of risk management and project administration
- Represented a joint venture contractor in connection with the construction of a new tunnel for the existing Chesapeake Bay Bridge-Tunnel in Virginia, to include the prosecution and defense of claims relating to the subcontractor responsible for designing and constructing the slurry walls for the project
- Represented an international engineering, procurement and construction (EPC) contractor in disputes stemming from the conversion of an existing coal-fired power plant in Pennsylvania to the largest waste coal burning power plant utilizing circular fluid bed technology for power generation
- Represented an international EPC contractor in dispute with mechanical contractor concerning faulty installation of piping for combined cycle natural gas-fired power plant located in New York
- Represented a prime contractor on a myriad of issues concerning project administration and claims resolution arising from the design and construction of a bio-fuel steam/power co-generation plant on the campus of a U.S. Department of Veterans Affairs (VA) medical facility in New York
- Represented a prime contractor in pursuing claims for extended performance and other costs arising from the demolition and construction of a U.S. Navy port facility located in Rhode Island
- Represented a prime contractor in pursuing and defending multimillion-dollar claims arising from the design and construction of a new municipal combined sewer overflow system in Michigan
- Represented a major subcontractor in pursuing and defending claims for extended performance arising from the runway rehabilitation and expansion at Baltimore/Washington International Thurgood Marshall Airport
- Assisted an international infrastructure contractor in the comprehensive drafting and revision of public-private partnership (P3) contract documents
- Represented a prime contractor in the prosecution and defense of claims arising from the construction of a prominent high-rise residential tower situated in the Inner Harbor area of Baltimore, Maryland
- Represented one of the largest building contractors in the United States in a dispute with the owner of a high-profile museum project in Maryland
- Represented a large developer in the Washington, D.C. region in its pursuit of claims against a general contractor arising from the construction of simultaneous multifamily, mixed-use developments in Maryland and Virginia
- Represented a developer in a complex dispute concerning the design and construction of 417-room hotel resort project in Miami Beach, Florida
- Represented an international developer in connection with the resolution of significant claims stemming from the complete renovation and partial construction of historic 317-room hotel property in Washington, D.C.
- Represented a large mechanical contractor in defense of claims involving water infiltration and mold relating to the construction of high-rise condominium project
- Represented a large international contractor before the Armed Services Board of Contract Appeals (ASBCA) in connection with multiple claims against the Naval Facilities Engineering Systems Command (NAVFAC) for unpaid work performed on a military installation in North Carolina
- Represented a large specialty subcontractor in connection with unpaid services performed on a project for the U.S. Army Corps of Engineers (USACE) located at the Aberdeen Proving Grounds facility in Maryland
- Represented the John F. Kennedy Center for the Performing Arts located in Washington, D.C., concerning the construction and close-out of its upgrade and expansion project known as "The REACH"
- Represented one of the largest general contractors in the United States in connection with its project administration and claims management concerning a design-build bio-fuel cogeneration plant on a 150-acre government hospital campus in upstate New York
- Represented a large international contractor in a dispute arising from a dredging project for the USACE in the navigable waters of San Juan, Puerto Rico, which entailed various claims raised and resolved between multiple parties in federal court
- Represented a large specialty subcontractor in connection with project administration and claims for outstanding payment before the ASBCA for work performed at the direction of the USACE on a large hospital project located at Fort Bliss, Texas
- Represented two of five intervenors in a bid protest action before the U.S. Court of Federal Claims concerning Multiple Award Task Order Contracts (MATOC) awarded by the USACE to perform extensive construction and design-build services
- Represented an engineering, procurement and construction (EPC) contractor in connection with the construction of a 378 megawatt (MW) combined-cycle power facility in El Salvador, with the representation focusing on project administration and claims-related matters
- Represented the construction manager responsible for the renovation and construction of the Hungarian Embassy in Washington, D.C., to include advising the client on matters of risk management and project administration during construction
- Represented an international prime contractor in the resolution of claims arising from construction activities at Bagram Airfield, Afghanistan
- Assisted an international subcontractor in the preparation of claims arising from the construction of a hotel resort in Baku, Azerbaijan
