Florida High Court Makes It Harder to Challenge Bond Validations

A recent Florida Supreme Court ruling overturned decades of case law and makes it more difficult to challenge bond validations. Attorney Michael Wiener said Holland & Knight typically waits to close on a bond issue until after the 30-day appeal period ends, in part because a Florida validation case also involves the local state attorney.

“You would have some certainty that during the 30-day period no other parties could appear to appeal the decision,” Mr. Wiener said.
