ACO Proposed Rules: Understanding the Key Aspects of this New Accountable Delivery Model

The firm's Healthcare & Life Sciences will host the first in a series of accountable care organization (ACO) webinars titled "ACO Proposed Rules: Understanding the Key Aspects of this New Accountable Delivery Model."

On March 31, the Centers for Medicare and Medicaid Services (CMS) and several other federal agencies proposed a regulatory framework for ACOs participating in the Medicare Shared Savings Program. Section 3022 of the Affordable Care Act (ACA) establishes a Medicare Shared Savings Program for ACOs, to be implemented on January 1, 2012. The ACA allows providers to form ACOs that will be held accountable for improving the health and experience of care for individuals, improving the health of populations and reducing the rate of growth in healthcare spending. The Shared Savings Program rewards ACOs with a percentage of the resulting shared savings if the ACO meets both financial and quality benchmarks.

In the webinar, panelists will discuss a number of issues related to the proposed framework, including the following:

  • key ACA definitions and provisions
  • legal entity and ACO governance requirements
  • medicare beneficiary rights and assignment to an ACO
  • overview of quality and other reporting requirements
  • ACO savings and risk-sharing arrangements
  • the legal challenges in forming ACOs and sharing payments with ACO participants
  • potential issues in formal comments on the proposed rule to CMS
