Topics of discussion will include the status of GSA's ongoing audits of prior real estate tax adjustments and offset of rents in GSA leases in Arlington County, Va., as well as the government's proposed regulations to mandate disclosure of government contractors' violations of worker protection laws.

In an ongoing audit of its leases nationwide, GSA has offset rent multiple times in its leases for space in Arlington County, alleging the overpayment of real estate tax adjustments due to errors in the definition of real estate taxes and the initial determination of base-year taxes. We will discuss the grounds and process for challenging GSA's position on this issue.

Following last year's "Fair Pay and Safe Workplaces" executive order, the government recently proposed to amend Federal Acquisition Regulation to mandate disclosure by government contractors of violations of 15 categories of labor and health and safety laws, including OSHA, the FLSA and the Davis-Bacon Act. The proposal requires reporting of violations resulting from an administrative merits determination, an arbitral award or decision, or a civil judgment – even if the proceedings are not final. The proposed regulations therefore fundamentally change how contracts will be awarded and the relationship between prime contractors and their subcontractors. An opportunity to comment on the proposed changes exists through July 27, 2015.
