At the American Bar Association Section of Public Contract Law's 2018 Annual Meeting in Chicago, attorney Rodney Perry will speak on the "How the Sausage Gets Made: FAR/DFARS Rulemaking and the Interplay Between Administrative Law and Procurement Law" panel.

The panel will feature a behind-the-scenes look at the cryptic, often opaque processes behind Federal Acquisition Regulation (FAR) and its Defense Federal Acquisition Regulation Supplement (DFARS), as well as explore the ways in which procurement law and administrative law co-exist. Topics will include: the intersection of administrative law and procurement law; the FAR/DFARS rulemaking process; legislative and executive conflicts between the FAR and federal statutes; APA vs. Tucker Act jurisdiction; and a discussion of the 2016 litigation that resulted in the injunction of the “Fair Pay and Safe Workplaces” Final Rule.
