Holland & Knight attorneys will present two different panels at the National 8(a) Association Summer meeting in Anchorage.

Attorneys Bob Tompkins and Jim Harris will present on Facility Clearance issues and the Defense Security Service, including special issues affecting 8(a) contractors. Their presentation will focus in particular on the requirement announced Friday May 20, that all cleared contractors establish an Insider Threat Program.

Attorneys Bob Tompkins and Sarah Curtis will present on advanced compliance program concepts with a focus on various disclosure requirements that can arise in the course of internal investigations of government contractors, including under the Mandatory Disclosure Rule, the federal notification system known as “FAPIIS,” and as suggested by the federal sentencing guidelines. They will discuss the ancillary steps that go with an investigation, including:

  • identifying potential disclosure obligations early in the investigation 
  • incorporating the potential for disclosures in the investigation plan 
  • the potential for suspension and debarment and other contractor eligibility impacts, including those that affect parent companies and affiliates
