Please join Holland & Knight's Government Contracts Group for "Small Business Runway Extension Act (SBREA): Next Steps in Implementation." Partners David Black and Robert Tompkins will provide insights into the new legislation, signed by President Donald Trump in December 2018.

SBREA amended the Small Business Act and the method used to determine the size of firms in industries with receipts-based standards by changing the lookback period for average annual revenue to five years rather than three years.

Topics include:

  • understanding the SBA's position that SBREA did not take immediate effect and that the three-year lookback period remains in place until further notice
  • the timing of rulemaking by the SBA to amend its regulations to incorporate SBREA
  • whether and how contractors can base size status on a five-year lookback period given the current state of play
  • the possibility for additional legislation by Congress to confirm the immediate effect of the five-year lookback and to possibly provide a transition period during which both lookback periods can be used
  • the formation of a new special purpose coalition of interested contractors represented by Holland & Knight to advocate for additional legislative and regulatory action to implement the five-year rule and provide a reasonable phase-out period for the three-year rule
