FCA Cooperation Guidance Still Missing Key Details

White Collar Defense and Investigations Attorney Megan Jeschke spoke with Law360 on the U.S. Department of Justice's (DOJ) recently updated guidance that breaks down how targets of False Claims Act (FCA) suits can get credit for helping investigators, but the new rules lack key details on the benefits of cooperation. Ms. Jeschke frequently represents FCA defendants and welcomed the guidance as it provides the DOJ's value in cooperation.

"It’s nice to have solid guidance from DOJ on things that it values in cooperation," Ms. Jeschke said. "Practitioners in this space are generally aware of these concepts, but to be able to see them in writing as guidance to all [relevant DOJ staff] is great."
