Huawei Lawsuit Accuses U.S. of ‘Unconstitutional’ Equipment Ban

Partner Eric Crusius was quoted by Financial Times involving the Huawei lawsuit against the U.S. for "unconstitutional" restrictions involving the equipment ban from the telecoms group. A similar lawsuit was filed in 2017, regarding a Russian cyber security company that U.S. officials banned from government systems. However, the lawsuit failed after a judge stated "the U.S. government was legitimately protecting its own interests."

“If the lawsuit goes to discovery, that would be a big win for Huawei because they (or their attorneys) would have the opportunity to see the basis for the ban and depose various government officials. It would also demonstrate to the world that their suit has merit," stated Mr. Crusius.

“On the other hand, the government would have the right to receive documents from Huawei about their relationship with the Chinese government and depose company officials," he added.
