New ABA Communications Guidelines Looks for 21st Century

The ABA Standing Committee noted that ethically, it is a lawyer's duty to protect client confidentiality in electronic communications. In 2012, the ABA adopted the "technology amendments" which obligates lawyers to competently represent clients. The communication between a lawyer and client is highly sensitive, which requires the lawyer to inform the client of the risks involved if the information is transmitted elsewhere.
