Chevron Case: Supreme Court Could Take Sledgehammer to Agency Power
Litigation attorney Timothy Taylor was quoted by The Hill in an article about the U.S. Supreme Court's decision to hear a case that could have far-reaching implications for administrative agencies. The case in question challenges the 39-year-old precedent established in Chevron U.S.A. v. Natural Resources Defense Council, which created what is known as Chevron deference. The court's decision could have a wide range of effects on the executive branch's authority to implement certain environment, employment, drug and other regulations. Mr. Taylor shared his thoughts on the case and its potential outcome.
"Scaling back, I think, is the more likely outcome rather than outright overruling. There are a fair number of Chevron skeptics on the court, but again, that would be a very dramatic change," he said.
