Partner Leon Fresco Comments on Legal Challenges to Parole in Place Program
Immigration attorney Leon Fresco was featured in an interview with Spectrum News and on an episode of the Bloomberg Law Podcast about a legal challenge from 16 states to the Biden Administration's program creating a pathway to citizenship for immigrant spouses of U.S. citizens. Under the program, known as Keeping Families Together or Parole in Place, individuals who are married to U.S. citizens but who cannot obtain legal status because they entered the United States illegally can receive "parole," which Mr. Fresco described as "a permission slip" to apply for a green card and become a lawful permanent resident without having to leave the country and reenter legally. On Aug. 26, 2024, a Texas federal judge ordered a temporary pause on the program after the states filed suit. In the interviews, Mr. Fresco explains how the program works and what its requirements are, as well as breaks down the states' arguments against its legality.
