Washington Watch: Trump Regulatory Changes Afoot for Pipelines

Underground Infrastructure
Environment attorney Rafe Petersen was quoted in an Underground Infrastructure article about potential regulatory changes affecting pipelines under the second Trump Administration. The article detailed how the new government might revisit and alter Biden-era environmental rules, such as those involving the National Environmental Policy Act (NEPA) and Clean Water Act, that impact the scope of pipeline projects. Mr. Petersen highlighted the possibility of significant revisions to align current regulations with recent court decisions, including the U.S. Supreme Court's ruling in Sackett v. EPA, which could redefine key environmental terms and standards.

"I believe that the Trump II Administration will take a hard look at the current rule for consistency with Sackett. I would also expect them to consider putting back definitions of what is not a WOTUS," he said.
