Joshua Steven Cunningham

Joshua Cunningham is a government attorney in Holland & Knight's Washington, D.C., office. Mr. Cunningham focuses his practice on legislative, regulatory and government relations matters affecting the energy, oil and gas, natural resources and offshore sectors.

Mr. Cunningham represents businesses and trade associations on energy and infrastructure development projects, including those on federal lands and waters. He advocates before the U.S. Congress, federal agencies and state legislators on policy initiatives, rulemaking proceedings, and strategies for engagement with government decision-makers. His experience includes advising oil and gas, pipeline, storage and liquefied natural gas (LNG) companies on the development and operation of large-scale energy infrastructure, as well as administrative and judicial proceedings involving challenges to federal agency actions and jurisdictional disputes.

Mr. Cunningham represents clients before federal agencies and administrative bodies, including the U.S. Department of the Interior's Bureau of Safety and Environmental Enforcement (BSEE), Bureau of Ocean Energy Management (BOEM) and Board of Land Appeals (IBLA), along with the U.S. Department of Transportation's Pipeline and Hazardous Materials Safety Administration (PHMSA) and U.S. Department of Energy (DOE).

Mr. Cunningham counsels energy clients on regulatory compliance, environmental review, permitting and operational matters, including matters arising under federal statutes such as the Outer Continental Shelf Lands Act (OCSLA), Coastal Zone Management Act (CZMA), Migratory Bird Treaty Act (MBTA), Oil Pollution Act (OPA), Clean Water Act (CWA), Endangered Species Act (ESA), Marine Mammal Protection Act (MMPA) and National Environmental Policy Act (NEPA). He also advises on the emerging regulatory landscape for carbon dioxide (CO₂) pipelines and related infrastructure, as well as offshore renewable energy development.

Prior to joining Holland & Knight, Mr. Cunningham practiced at another global law firm in Washington, D.C., where he represented energy clients in complex regulatory and administrative litigation matters before the Federal Energy Regulatory Commission (FERC). He also advised LNG and pipeline operators on permitting, safety compliance, investigations and enforcement actions involving PHMSA, as well as assisted offshore energy developers with environmental and administrative challenges before federal agencies and courts.

While in law school, Mr. Cunningham focused on energy law and its intersection with international law and policy. He served on The George Washington Journal of Energy and Environmental Law, participated in public policy and government relations initiatives, was an active member of Lambda Law and worked as a law clerk for several nonprofit organizations.
