Overview
Mike Decembrino is a litigation and dispute resolution attorney in Holland & Knight's Jacksonville office where he focuses his practice on a variety of commercial litigation matters in state and federal court, both locally and nationally. Mr. Decembrino's practice includes business, banking, real estate, insurance and contract disputes, as well as class actions across various industries. He also frequently handles cases and counsels clients regarding non-competition and non-solicitation agreements, along with other matters involving business torts, shareholder disputes, negligence and product liability.
Mr. Decembrino has robust experience with state laws across the nation that regulate the conduct of equipment manufacturers, distributors and dealers. He counsels clients regarding compliance with these extensive regulations and represents them in controversies arising from the same.
Prior to joining Holland & Knight, Mr. Decembrino served as a judicial extern to the Honorable Timothy J. Corrigan of the U.S. District Court for the Middle District of Florida and the Honorable Robert M. Dees of the Fourth Judicial Circuit Court of Florida.
In law school, Mr. Decembrino graduated second in his class. He served as a teaching assistant for courses in legal writing and appellate advocacy, a research editor of the Florida Law Review and a member of the Honor Committee. He also served as a summer associate in Holland & Knight's Jacksonville office for two consecutive summers.
Before law school, Mr. Decembrino worked as a college admissions officer and high school counselor in addition to coaching baseball at the college and high school levels. In the community, Mr. Decembrino is involved with the Cystic Fibrosis Foundation and maintains an active pro bono practice assisting military veterans.
Representative Experience
- Represented a banking institution against various claims involving alleged erroneous wire transfers, check fraud and fraudulent electronic transfers, including claims governed by Articles 4 and 4A of the Uniform Commercial Code
- Represented a banking institution in claims involving possible theft of funds, successfully recovering erroneous overpayment without litigation
- Represented a banking institution against claims for negligence, breach of fiduciary duty and negligence per se asserted by a customer claiming more than $2 million in damages, obtaining dismissal of all claims at the pleadings stage
- Represented a banking institution against a negligence claim asserted by a customer claiming approximately $1 million in damages, obtaining dismissal at the pleadings stage
- Represented a banking institution against claims for negligent reporting of a crime and false imprisonment
- Routinely counsels a nationwide distributor of heavy equipment and machinery regarding compliance with state laws regulating the conduct of equipment manufacturers, distributors and dealers
- Represented an international agricultural and power equipment manufacturer against claims alleging wrongful termination of dealership agreement
- Represented a property developer against claims related to alleged construction defects, obtaining dismissal at the pleadings stage
- Represented a seller of real property against fraud and non-disclosure claims, obtaining dismissal at the pleadings stage
- Represented a condominium owner in a dispute over improvements to real property and breach of fiduciary duty claims
- Represented a major health insurer in breach of contract claim alleging unpaid commissions and wrongful termination at trial and appellate court levels, obtaining dismissal at the pleadings stage, which was affirmed on appeal
- Represented a major health insurer in claim brought under Employee Retirement Income Security Act of 1974 (ERISA) Section 502(a), obtaining final summary judgment
- Represented a major health insurer in hundreds of matters alleging underpayment of claims under Florida's emergency services statutes
- Represented a class of approximately 2 million nationwide consumers in Florida state and federal courts in multimillion-dollar class actions against a manufacturer of sunglasses, alleging claims under the Magnuson-Moss Warranty Act and the Florida Deceptive and Unfair Trade Practices Act (FDUTPA)
- Represented a financial services corporation in claims brought under the Fair Debt Collection Practices Act (FDCPA) and Florida Consumer Collection Practices Act
- Represented a technology investor in claims involving breach of contract, fraud and tortious interference at the trial court and appellate level
- Represented the owner of a closely held real estate development company in an ownership dispute and shareholder's derivative action
- Represented an auto services company against conversion claims, obtaining final summary judgment
