Overview
Michael V. Fiorillo is an attorney in Holland & Knight's Boston office and a member of the Litigation and Dispute Resolution Practice. Mr. Fiorillo focuses his practice on general civil litigation, energy and environmental law.
In the general civil litigation context, Mr. Fiorillo has helped clients by holding third-party service providers accountable for their negligence, defending client property against adverse possession claims, navigating corporate management, fiduciary duty and breach of contract disputes across various industries, and aiding in achieving a dismissal of a class action lawsuit for a data breach claim seeking millions of dollars in damages.
Mr. Fiorillo's experience in the energy sector includes helping clients navigate offshore wind permitting regulations, local solar tax ordinances and utility contract disputes, as well as assisting with due diligence related to forward capacity market bidding.
For environmental clients, Mr. Fiorillo has conducted fate and transport analyses to determine potential Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and tort-based liability, analyzed civil claims in the Clean Water Act (CWA) context and helped either defend against or settle enforcement actions related to the Massachusetts Clean Waters Act, Massachusetts Wetlands Protection Act and Massachusetts asbestos regulations.
Mr. Fiorillo also has a robust pro bono practice and has helped people apply for asylum in the U.S., sued for more humane treatment for people who are incarcerated, conducted research on energy affordability issues and assisted a wildlife rehabilitation facility with their volunteer indemnification and release forms.
While in law school, Mr. Fiorillo was a summer associate in Holland & Knight's Boston office. He also worked as a judicial intern for the Honorable Allison D. Burroughs of the U.S. District Court for the District of Massachusetts, researched environmental legal issues for nonprofit organizations in the Boston area and co-taught an environmental law class at Boston College.
Before law school, Mr. Fiorillo worked as a litigation and antitrust paralegal, where he assisted with Hart-Scott-Rodino filings, Second Request responses, and discovery management and motion practice for class action lawsuits related to the Clean Air Act (CAA).
Additionally, Mr. Fiorillo worked in Brazil for two years with the U.S. Department of State and the Fulbright Commission – Brazil under a Fulbright grant as an English teaching assistant.
