Overview

Kathryn Isted is a litigation attorney in Holland & Knight's Tallahassee office. Ms. Isted's practice focuses on commercial, administrative and appellate litigation, with experience in prosecuting and defending a broad range of complex litigation matters in federal court, state court and arbitration.

As part of her practice, Ms. Isted has particular experience in representing licensors and franchisors in disputes against their former franchisees and licensees. She has assisted those clients in recovering millions of dollars from their former licensees and franchisees, and has successfully defended them against breach of contract and fraud-based claims and counterclaims. She also has experience defending telecommunications companies against claims arising under consumer protection statutes, such as the Fair Credit Reporting Act (FCRA) and the Fair Debt Collection Practices Act (FDCPA).

Ms. Isted's representative matters include:

  • representing a licensor in a bench trial in which the court awarded the licensor its future lost profits for the entire duration of the license agreement's term in an amount exceeding $3 million, plus attorneys' fees of more than $700,000
  • representing a franchisor in winning summary judgment and, thereafter, in having the judgment affirmed by the Court of Appeals of Georgia, generating favorable precedent for the franchisor for future cases
  • representing a bank in successfully compelling the plaintiff to arbitrate his claims on an individual basis, resulting in the dismissal of the plaintiff's purported class action claims
  • leading the defense of a multiplaintiff action against a franchisor, resulting in the plaintiffs' voluntary dismissal of the entire action and the payment of a portion of the franchisor's attorneys' fees
  • authoring a briefing that prevented the plaintiff from filing a class action against a telecommunications company because the court found that the plaintiff's alleged invasion of privacy was insufficient to assert a concrete injury necessary to confer Article III standing
