Overview

Evan Neustater is an environmental attorney in Holland & Knight's Washington, D.C., office. Mr. Neustater focuses his practice on environmental enforcement defense, regulatory compliance and environmental litigation, with an emphasis on high-stakes government investigations, penalty mitigation and compliance program design and implementation.

Mr. Neustater represents clients in federal and state environmental enforcement matters and complex environmental litigation under a range of environmental statutes, including the Clean Air Act (CAA), Clean Water Act (CWA), Resource Conservation and Recovery Act (RCRA) and Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). His experience includes managing matters from inception through resolution, including conducting fact investigations, drafting motions, pleadings and legal memoranda, managing domestic and cross‑border discovery, negotiating settlements and advising on litigation and compliance strategy. He has served as counsel in enforcement proceedings, securing significant penalty reductions and assisting clients with the design and implementation of comprehensive environmental compliance programs.

Mr. Neustater has extensive experience with FIFRA, including enforcement defense, regulatory compliance counseling and data compensation arbitrations. He has led the drafting of statements of position and developed strategy in multimillion‑dollar FIFRA arbitration disputes and regularly advises clients on compliance obligations and enforcement risk under FIFRA and related regulatory frameworks.

Mr. Neustater leverages prior government experience as an attorney‑advisor with the U.S. Environmental Protection Agency (EPA) in the Office of Criminal Enforcement, Forensics and Training. In that role, he advised agency leadership and federal investigators on the application of environmental and criminal statutes in connection with criminal investigations, prosecutions and administrative matters. He also reviewed prosecution materials for legal sufficiency, participated in proffer sessions and supported charging and enforcement decisions. This experience provides him with first‑hand insight into government enforcement priorities and investigative strategy, which he brings to his representation of clients facing regulatory scrutiny.

Prior to joining Holland & Knight, Mr. Neustater was an attorney in private practice, where he advised clients on environmental compliance, enforcement actions and investigations, and environmental due diligence in commercial real estate matters. He also maintains an active pro bono practice, including handling sensitive family law matters and providing immigration‑related representation in humanitarian matters.
