ABA Section of Real Property, Trust & Estate Law Spring Symposia
International and Cross Border Transactions Partner Mark Stone and Real Estate Partner La Fonte Nesbitt will participate in the ABA Section of Real Property, Trust & Estate Law Annual Spring Symposia. Mr. Stone will chair a program titled, "U.S. Investors, Lenders and Tenants in Troubled Foreign Real Estate: Pitfalls and Opportunities in Getting Out and Getting In." Mr. Nesbitt will speak on a panel titled, "HUD, Fannie Mae and Freddie Mac Mortgage Loan Opinions: Do I really have to give that opinion?"
Mr. Stone will address topics including:
- U.S. laws relating to foreign investments, including the Patriot Act, Foreign Corrupt Practices Act, embargo and anti-boycott laws and investment provisions in bi-lateral treaties and free trade agreements
- Comparison of rights and obligations in foreign jurisdictions with generally understood U.S. rights, with focus on different available collateral structures and foreclosure rights for U.S. persons
Mr. Nesbitt will address topics including:
- The legal opinions required for different mortgage programs
- Whether such opinions can be reconciled with customary opinion practice
- Permitted variations from the prescribed forms
