Judge Strikes Down U.S. Dept. of Education Policy Over Immigration Requirements and Regulating Technology in Schools
Native American Law attorney James Meggesto was interviewed by Spectrum News 1 about a New York federal judge's rejection of a U.S. Department of Education (DOE) policy requiring certain American Indian students born in Canada, known as Jay Treaty students, to obtain immigration documents from the U.S. Department of Homeland Security (DHS) before they could receive federal student aid. The U.S. District Court for the Northern District of New York found the department went beyond its authority and failed to adequately explain why it reversed a longstanding policy. The court vacated the policy in its entirety, meaning that Jay Treaty students should no longer be required to obtain green cards or other DHS documentation to access federal student aid.
