Fifth Circuit Preserves Provider Flexibility in Collecting Patient Responsibility

The Fifth Circuit Court of Appeals recently issued its opinion in North Cypress Medical Center Operating Co. v. Cigna Healthcare, a case concerning the ability of a non-participating healthcare provider to discount a patient’s copayment, coinsurance, and deductible obligations and still seek payment from the patient’s insurance company.  This decision contains important information for any healthcare provider—in-network or out-of-network—to consider when enacting any sort of patient-responsibility discount program, including uninsured and underinsured discounting policies.
