California Court of Appeal Strikes Down CARB's Second Review of Low Carbon Fuel Standards

The California Air Resources Board's (CARB) violated the California Environmental Quality Act (CEQA) when the Low Carbon Fuel Standard (LCFS)  program went into effect. In POET, LLC v. State Air Resources Board, the court ruled that CARB failed to establish a proper baseline, which further held CARB accountable for violating CEQA policy because its environmental review was not completed before the regulations were approved.
