Texas Reins In Its Anti-SLAPP Statute to the Benefit of Trade-Secret Owners

On June 2, 2019 the Texas Legislature passed House Bill 2730 in response to growing concerns regarding the expansive use of the Texas Citizens Participation Act (TCPA). The significant changes include limiting a defendant’s ability to seek early dismissal under the TCPA in cases involving claims of trade-secret misappropriation, common law fraud claims, and covenants not to compete. The amendments also narrow the definition of a “matter of public concern” as it relates to the exercise of the rights of free speech and association to require that such rights relate to a public figure or a matter of public or social interest to the community.
