Summary Judgment: Just the Facts, Please

This column begins a discussion of rules to follow when preparing summary judgment papers; first is the statement of undisputed material facts, Superior Court Rule 9A(b)(5). Based on this rule, the authors offer two points to consider: 1) Stating facts as simply and as directly as possible and 2) Supporting facts with accurate citations. Following this advice makes it easier for a judge to decide a motion and harder for one's opponent to deny or undermine a case.
