Wealth Tax Increases with the Second Economic Emergency of the Year
Tax attorney Alberto Posada wrote an article for El Heraldo on the Colombian Ministry of Finance's announcement of a possible second declaration of a state of economic emergency – on the heels of one declared in December 2025 – prompted by the winter storm tragedy in Córdoba, and its impact on the adoption of new tax measures. Mr. Posada explains that, although the text of the decrees is not yet known, the government has proposed creating a wealth tax for legal entities with net worth exceeding approximately 10.4 billion pesos, with tiered rates of 0.6 percent and 1.2 percent depending on the level of wealth. The article examines concerns about the limits of emergency taxation, potential overlap of states of emergency and the risk that measures temporarily suspended by the Constitutional Court coincide with new provisions, significantly increasing the tax burden. It also analyzes the implications for companies' 2026 financial planning and operational modeling.
