High-volatility commercial real estate (HVCRE) loans defined in the Basel III international banking standard have raised some confusion among the banking industry and real estate. Attorneys say three questions are a source of this confusion, including how distributions are treated. Real Estate Attorney Susan Booth weighed in on the questions that arise from this uncertainty.
"Once the property is stabilized and running, [it's not clear] whether the borrower is able to get distributions," said Ms. Booth . "Different banks seem to be taking different positions on that."
