The Top Native American Rulings Of 2017: Midyear Report

There have been several rulings in 2017 that are significant in Native American Law such as tribal immunity case: Lewis v. Clarke. The case was an issue of sovereign immunity of Native American tribes and if it can be extended to tribal employees during their work-related activities.

"While the tribes may be immune, there still might be contractual or other means that a plaintiff, a creative plaintiff, a tenacious plaintiff is going to get a judgment that the tribes might have to be economically responsible for even if they're not technically legally responsible under the doctrine of sovereign immunity," Partner James Meggesto said. When a tribe's economic interest is at stake, they've got to take steps to make sure they have appropriate liability coverage," Mr. Meggesto added.
