Calif. Cities May Reconsider Blocking Affordable Housing

Law360

West Coast Land Use Attorney Daniel Golub was quoted in a Law360 article about his representation of affordable housing developer 40 Main Street Offices LLC in a case against the city of Los Altos, California. The developer filed suit against Los Altos alleging that the city violated Senate Bill 35, which requires cities that have not met certain targets for affordable housing to streamline certain projects. The California Superior Court agreed, ordering that Los Altos must issue permitting for the project it had sought to block. The decision clarifies that SB 35 has broad reach in requiring cities to streamline approval of certain projects.

"It is gratifying that the court agreed with our legal arguments, and we are proud to have achieved this important victory enforcing some of the state's cutting edge housing laws," Mr. Golub said.
