Biden Takes Aim at Consolidation in Ocean, Rail with New Executive Order

Maritime attorney Gerald Morrisey was quoted in an article for Supply Chain Dive about President Joe Biden's recent executive order aimed at increasing competition within the transportation industry. This executive order includes 72 initiatives to consolidate both the freight rail and ocean shipping industries. The Surface Transportation Board and Federal Maritime Commission have been prompted to use their regulatory power to enact change. Mr. Morrissey pointed out that the agencies are given their authority by Congress and likely won't be provided any new powers.

Mr. Morrissey also noted that the U.S. government is still able to regulate their business under the Shipping Act. This act requires carriers to act with reasonable practices and prevented them from boycotting, he said. He believes that in order to solve supply chain issues within the transportation industry, "Looking only at one player is not as likely to achieve meaningful and informed change."
